By accessing or using Open Journey ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not access or use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

Open Journey is an AI-powered image generation platform that allows users to create images from text prompts. The Service includes a web-based interface, API access (where available), and related tools and features.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to create an account and use the Service.

Free Plan

Open Journey offers a free plan with a limited number of image generation credits. Free credits are subject to daily or monthly limits as determined by us and may change without notice.

Paid Plans

Paid plans (Starter, Creator, Studio) provide additional credits and features. By subscribing to a paid plan, you agree to pay the applicable fees. All fees are billed in advance on a monthly basis and are non-refundable except as required by law.

Credits

Credits are consumed each time you generate an image. Unused credits from free plans do not roll over. Credit allocations and pricing are subject to change, and we will provide notice of any material changes to paid plans.

Cancellation

You may cancel your paid subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of that period. No partial refunds are provided for unused portions of a billing period.

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create images that depict minors in inappropriate or exploitative contexts
• Generate content that infringes on the intellectual property rights of others
• Produce deepfakes or misleading imagery intended to deceive or defraud
• Create content that promotes violence, hate speech, discrimination, or terrorism
• Attempt to reverse-engineer, decompile, or extract the underlying AI models
• Use automated systems (bots, scrapers) to access the Service without authorization
• Circumvent credit limits, usage restrictions, or security measures
• Resell or redistribute access to the Service without our written consent
• Use the Service in any way that could damage, disable, or impair its operation

We reserve the right to suspend or terminate accounts that violate these guidelines without notice or refund.

Your Prompts

You retain ownership of the text prompts you submit. By submitting prompts, you grant Open Journey a non-exclusive license to process them for the purpose of generating images and improving the Service.

Generated Images

For paid plan users, you are granted a broad license to use, modify, reproduce, and distribute images generated through the Service for personal and commercial purposes, subject to these Terms. For free plan users, generated images are licensed for personal, non-commercial use only.

Open Journey's Rights

Open Journey and its licensors retain all rights to the Service, including the AI models, algorithms, software, and technology. Nothing in these Terms transfers ownership of our intellectual property to you.

No Guarantee of Uniqueness

AI-generated images may be similar to images generated for other users using similar prompts. We do not guarantee that generated images will be unique or exclusive to you.

We employ automated systems and human review to detect and prevent the generation of prohibited content. We may:

• Refuse to generate images from prompts that violate our acceptable use policy
• Remove or disable access to generated content that violates these Terms
• Report illegal content to appropriate authorities
• Suspend or terminate accounts that repeatedly violate our policies

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant that generated images will meet your expectations, be accurate, or be free from defects. AI-generated content may contain errors, biases, or artifacts.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPEN JOURNEY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Open Journey and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may also update the AI models powering the Service, which could result in changes to image quality, style, or generation capabilities.

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data and generated images
• Any outstanding fees remain payable
• Provisions that by their nature should survive termination will survive (including intellectual property, disclaimers, limitations of liability, and indemnification)

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Open Journey operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of that jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Open Journey regarding the Service and supersede all prior agreements and understandings.
